Cutwood Joiners Operational Terms & Conditions

1. Payment Terms:
a. Payment Schedule: The customer agrees to pay the joiner in accordance with the agreed-upon payment schedule, which may include upfront deposits for materials and milestone payments.
b. Payment Method: Payments shall be made by: bank transfer, cash or credit card payments and the customer is responsible for any associated transaction fees.
c. Late Payments: Late payments may incur interest charges at 5% per week on the outstanding balance.

2. Work Guarantees:
a. Workmanship: Cutwood Joinery guarantees that all work will be performed in a professional and workmanlike manner, adhering to industry standards.
b. Defects: The joiner will correct, at no additional cost to the customer, any defects or deficiencies in the work that arise due to faulty workmanship within 2 weeks after completion. This does not apply to any damage post-installation caused by customer neglect, lack of care or accidental damage by a third party.
c. Materials: Any materials supplied by the joiner will be guaranteed as per the manufacturer’s warranty. The joiner is responsible for ensuring the customer is aware of these warranty terms.
d. Cutwood Joiners cannot be held responsible for client or third party rectifications or modifications to our work after installation.
e. Additional works requested by customers and not listed on the original quotation or statement of work will incur extra costs for materials and additional time to complete.

3. Materials Guarantee:
a. Quality of Materials: The joiner agrees to use materials of good quality and fit for the intended purpose. We cannot guarantee materials purchased or supplied by the customer.
b. Manufacturer Warranty: Any materials provided by the joiner that are subject to a manufacturer’s warranty will be passed on to the customer. The joiner will assist the customer in processing any warranty claims.
c. Limited Liability: The joiner’s liability for material defects is limited to the replacement or repair of the defective materials, as determined by the manufacturer’s warranty.

4. Changes and Additional Work:
a. Any changes or additional work requested by the customer must be agreed upon in writing, including adjustments to the project timeline and cost.

5. Delays:
a. The joiner is not liable for delays caused by circumstances beyond their control, such as adverse weather conditions, unavailability of materials, restricted site access or illness.

6. Insurance:
a. The joiner shall maintain appropriate insurance coverage, including public liability insurance, to cover any unforeseen accidents or damages during the course of the project. Our list of insurance coverage includes: Public Liability Insurance, Employers’ Liability Insurance, Professional Indemnity Insurance, Professional Indemnity Insurance, Contractors’ All Risks Insurance, Goods in Transit Insurance & Vehicle Insurance. Proof of our insurance policies is available on request.

7. Termination:
a. Either party may terminate the contract in writing for a material breach of its terms, with reasonable notice. The customer will be required to pay for materials, work time up until termination and any loss of earnings incurred due to the termination of an agreed job.

8. Dispute Resolution:
a. In the event of a dispute, both parties agree to attempt to resolve it through mediation or arbitration before pursuing legal action.

9. Compliance with Laws:
a. The joiner shall comply with all relevant laws, regulations, and building codes while performing the work and adhere to on-site health & safety regulations where applicable.

10. Governing Law:
a. This agreement shall be governed by and construed in accordance with the laws of Scotland.

11. Image & Content Usage
a. We reserve the right to display images and videos of our work and post customer reviews and comments on our workmanship and services online across our social media channels and website. Image samples of our work and highlighting customer reviews is an integral part of our business and helps us to secure future work. If you do not want Cutwood Joiners to use images or display reviews from your project, please let us know in advance.

12. Entire Agreement:
a. This contract of Cutwood Joiners terms & conditions constitutes the entire agreement between the parties and supersedes any prior understandings or agreements, whether written or verbal.
